GLAD Cheers Repeal of “1913” Law
Today, the Massachusetts legislature has repealed the “1913” law that prevented same - sex couples from most other states from marrying there. Governor Deval Patrick is
expected to sign the bill into law.
The repeal of the antiquated law, spearheaded in the legislature by MassEquality, was applauded by Gay & Lesbian Advocates & Defenders (GLAD). Representing eight
same-sex couples from out of state, GLAD went to court in 2004 to challenge then-Governor Romney’s use of the law to prevent them from marrying in Massachusetts.
“The fence of discrimination surrounding the state has been dismantled,” said Lee Swislow, Executive Director of GLAD. “This is the culmination of the hard work of many people since GLAD first won the right of same-sex couples to marry in Goodridge nearly five years ago.” She added, “We’re grateful for the resolute leadership of Governor Patrick, Senators Therese Murray and Dianne Wilkerson, Rep. Byron Rushing, and Speaker Sal DiMasi on this issue. We also salute our partners at MassEquality for their work ensuring that this unfair law was finally repealed.”
Once the bill goes into effect, couples from every state will be able to come to Massachusetts to marry. GLAD urges couples from other states who are contemplating marriage to visit GLAD’s website, http://www.glad.org or ca,ll its InfoLine, at 1-800-455-4523.
A 2006 decision in GLAD’s lawsuit Cote-Whitacre v. Department of Public Health successfully opened the border to couples from Rhode Island and led to the same for New
Mexico.
