Lawyers for Edith Windsor File Brief Asking SCOTUS to Overturn DOMA
Today lawyers for Edith Windsor filed a brief in United States Supreme Court asking the Court to find Section 3 of the Defense of Marriage Act (DOMA) unconstitutional on the grounds that it violates Ms. Windsor’s “right to the equal protections of the laws as guaranteed by the Fifth Amendment.”
Ms. Windsor is challenging DOMA as discriminatory, in the case known as Windsor v. United States, because the law requires her to pay taxes on the estate of her late wife, Thea Spyer, that a different-sex spouse would not be required to pay.
