Great news for transgender taxpayers!
The IRS has issued an advisory known as an “action on decision” making clear that it will fully comply with GLAD’s Tax Court victory on behalf of Rhiannon O’Donnabhain. This means that going forward, the IRS will treat claims for deductions of medical expenses related to gender identity disorder - including but not limited to hormone therapy and sex reassignment surgeries - the same as expenses for any other medical condition. This final action puts to rest any open questions about the scope of the tax court decision.
